Article 1er.Pour l'application du préent arrêté, il faut entendre par " ancienneté de service " l'ancienneté acquise à la Régie des Voies aériennes.

Est fixé dans l'échelle de traitements 11/6, par le principalat, le traitement de tout météorologiste de 1ère classe qui remplit les deux conditions ci-après :
1°compter au moins 9 ans de grade;
2°présenter un mémoire scientifique de météorologie aéronautique.

Art. 4.La rémunération des agents repris ci-après est fixée comme suit :

Art. 5.Un complément de traitement dont le montant est déterminé ci-après est octroyé au titulaire d'un des grades suivants qui relèvent de la circulation aérienne et pour autant qu'il assure d'une manière directe et effective le contrôle de la circulation aérienne.

20 1 x 5 819Le complément de traitement est liquidé mensuellement. Il n'est pas dû pour toute interruption dans l'exercice effectif de la fonction dans les cas déterminés ci-après :
1. pendant un congé pour convenances personnelles;
2. pendant un appel ou rappel sous les armes;
3. pendant un terme de mise en disponibilité;
4. pendant le temps nécessaire pour comparaître devant une instance judiciaire ou devant un Collège d'experts pour des affaires qui ne sont pas en corrélation avec l'exercice de la fonction.
Pour la détermination du montant du complément de traitement, est admissible la durée des services rendus dans le ou les grades auxquels le complément de traitement considéré est lié-y compris la durée des services rendus dans des fonctions correspondant aux grades existant avant le 1er janvier 1970 assimilables aux nouveaux grades.
Sont également pris en considération :
1. les périodes d'appel ou de rappel sous les drapeaux pour autant que les agents intéressés possèdent la formation de base de contrôleur de 3ème classe de la circulation aérienne ou la qualification correspondant à un grade du contrôle de la circulation aérienne;
2. les congés non rémunérés considérés comme activité de service, octroyés en vue d'accomplir une mission spéciale et pour autant que celle-ci soit reconnue d'intérêt général et qu'elle représente un intérêt évident pour le pays ou pour le gouvernement ou pour l'administration belge;
3. les fonctions supérieures exercées sans interruption dans un grade déterminé.
Le complément de traitement est liquidé mensuellement.
Tout agent qui cesse d'exercer, pour quelque raison que ce soit une fonction à laquelle est rattachée un complément de traitement, conserve un partie de celui-ci s'il a effectué pendant au moins dix ans du contrôle directe et effectif de la circulation aérienne.
La partie ainsi maintenue est fixée à 26 %. Chaque année au delà de dix ans donne droit à 4 % supplémentaires jusqu'à concurrence de 66 % représentant un maximum de vingt ans.
L'agent promu à l'un des grades repris ci-après conserve un pourcentage du montant du complément de traitement qu'il détenait dans le dernier grade où il effectuait du contrôle direct et effectif fixé comme suit :
87,50 % pour l'expert principal ATS,
87,50 % pour l'expert ATS,
66,66 % pour le directeur ATS,
50 % pour le directeur d'administration ATS.
Art. 6.Le présent arrêté produit ses effets le 1er novembre 1992.
Art. 7.Notre Ministre des Transports est chargé de l'exécution du présent arrêté.
